This Policy is intended to ensure that Customer Personal Data is collected, maintained and used in accordance with data protection and privacy laws. This policy describes what kind of data Kinetix will collect from our customers, and how we maintain and use the data.
This Policy is hereby expressly incorporated into our user terms governing the provision of services. This Policy supplements our agreement, and is effective as of June 6, 2019. This Policy shall supersede any directly conflicting data provisions in other agreements. The Policy shall have no effect in geographical areas not subject to the law.

Personal Data Collected:
Kinetix collects Personal Data as described in the Contract, in particular from application forms, contact forms, and/or other interactions. Users should be aware that some required fields could be based on needs to comply with legal or contractual obligations, internal control purposes or in an effort to service a user. Kinetix may request Email, Phone Number, Name, Address, or other information. If a user contacts Kinetix, we will keep a record of that correspondence as required.
Personal Data provided should not include the following and users agree not to provide the following:
- Racial or Ethnic Origin;
- Political Opinions, Religion, or Beliefs;
- Trade Union Membership;
- Medical, Health or Biometric Data; or
- A Person’s Life or Orientation.
Kinetix may use Customer Personal Data to send direct marketing to our Customers via e-mail when a User has given express prior consent. Users may at any time withdraw approval to receive such marketing materials.
We may collect log data, or information that your browser sends when you visit our website. This data may include information such as user statistics, your computer’s IP address, browser type, browser version, date and time of visit and the amount of time you spent on the site. This information may be used to enhance your user experience or share this information with a third party for marketing purposes. We may use third party services such as Google Analytics and MailChimp to monitor and research the user experience to increase functionality. These third-party service providers have their own data and privacy policies.
We may send to your browser from our site some data in order to improve our services, and the user experience. You may disable cookies by choosing that option on your browser. If you do not accept cookies, you may not be able to use some features of our Platform.
Information Collected from Users
If you choose to become a User, in addition to the information we collect from you as a Visitor (as described above) you may also provide us with further personal information. If you choose to create an account using a social network login we do not collect login or password information.
Information from Surveys and Questionnaires
If you choose to participate in a survey or questionnaire your information will be treated as if you were a User.
Information May Be Disclosed
- To third-party providers, partners, vendors or affiliates;
- As required by professionals such as accountants, and lawyers; or
- As required by law or regulation.
The above parties are prohibited from using the data for any purpose other than for which it was intended.
Customer Personal Data Use
Customer Personal Data is collected and handled by Kinetix:
- to deliver Kinetix services
- to service Kinetix Users
- to comply with applicable rules

You have the right to know whether we process personal information about you, and if we do, to access data that we hold about you and how we use it and who we share it with.
The European Union’s General Data Protection Regulation “GDPR”, applies. In certain circumstances and subject to data processing agreements, you have rights in relation to your personal information. To exercise any of your rights, please email [email protected] Please note that for each of the rights below we may have valid legal reasons to refuse your request, in such instances we will let you know if that is the case.
Transferable and Corrections
You have the right to receive your personal information you have provided us. We will have to verify your identity before any such transfer can take place. You also have the right to make any necessary corrections to your data set.
Removal of Data, Stop Processing or Objection
You may request that we remove your data or stop processing data about you for reasons that include, but are not limited to:
- you no longer believe it is needed;
- you wish to withdraw;
- you no longer wish us to use your data;
- you believe we are unlawfully collecting or not protecting your information;
- you believe the information is not accurate;
- you believe we no longer need the data;

Personal Data Processing
The use of personal data by Kinetix as described is permitted on the basis that it is:
- necessary for the user experience and services provided;
- subject to Customer’s acceptance, “Opt-In”
- is required by law or rule within a vendor obligation;
Sharing User Data with Third Parties
To facilitate the platform’s performance and services and the efficient delivery of products, it may be necessary to share User Data to our family of companies, partners, vendors or affiliates. Such disclosure will only occur:
- to company subcontractors, suppliers, advisors, and agents;
- to recipients on a need basis to perform their duties. They are not permitted to use the information for any other purpose. These recipients will be subject to contractual obligations as regards data protection and confidentiality;
- to other entities owned by Kinetix (entities directly or indirectly controlled by Kinetix or its beneficial owner).
Does Kinetix Transfer European or Other User Data Outside the European Union or the User’s Host Country?
Yes, it is possible. European User Personal Data and others can be transferred and processed in other countries outside the European Union (EU). Kinetix shall transfer User Personal Data outside the EU and to those countries where we believe the appropriate safeguards to preserve privacy have been implemented.
Kinetix will do its best to protect Customer Personal Data, every Customer should be aware and is hereby informed that the transmission of information via the internet is not 100% secure. Bad actors may steal your data. Kinetix takes precautions and security measures to protect any transmission, but cannot guarantee security from your location. Protect your data locally, secure your devices, networks and computers, and for this reason, any transmission of information is at your own risk.
Kinetix will use industry standard (or better) technical and security measures safeguarding against unauthorized access, change, transmission or removal of User Data.
